If you are a US Citizen or Green Card-holding parent and have a child that is from another country, you may apply for their Green Card.

Benefits of Green Card for Children of US Citizen

1.  Live in the United States permanently.

Once approved, your child will be able to live in the United States.

2.  Public Education

Your child will have access to schools in the USA and be able to attend classes from Pre-K to high school.

3.  Public University

If your son or daughter has completed high school (or its equivalent) they will be able to apply and attend universities here in the United States without a Student Visa.

4.  Work in the United States.

When your son or daughter reaches the legal age to work in the USA, a Green Card will allow them to legally work in the USA.

5.  Social Security Number

Your child will be able to get a social security number.

6.  Driver’s License

Your son or daughter will also be able to apply for a State Driver’s License in the state they live in.

7.  Eligibility to Apply for US Citizenship

General Requirements of Green Card for Children of a US Citizen

When applying for a Green Card for a child, there is 1 main requirement that the government looks at when deciding to approve your application:

You must be legally related to your child.  In order to apply for a Green Card for your child, you must legally be your child’s mother or father.   This is normally proven by providing a government issued birth certificate with the child and parents name on it or other legal documents showing the relationship between parent and child.

Green Card Application Process for Children of a US Citizen

The application process for a Green Card depends on where the non-US Citizen child lives.  There are two options:

Option 1.  Child Living in the USA – Green Card Interview in the USA (Adjustment of Status)

The application process for a child that currently lives in the United States is a “one-step” process and would look something like this:

•  Green Card Document Checklist

•  Prepare Green Card Application for Child

Once you and your child have provided our office with the required documents, we prepare and submit your application to the US government.

•  Work and Travel Permit

Once your child’s Green Card application has been submitted, your child may be eligible to receive a work and travel permit. With this permit, your child can get a social security number and work legally in the US while the Green Card application is pending.

•  Green Card Interview in the USA

The last step of the process is the Green Card interview. The purpose of this interview is for a US government official to determine whether you meet the requirements for getting a Green Card and to confirm that you and your child are legally related as parent and child. This interview is done at a US government office inside the USA.

Option 2.  Child Living Outside the USA – Interview Outside the USA (Consular Processing)

What if the Child lives outside of the United States? Then the application process changes to a “two-step” process and would look like this:

•  Document Checklist

Once you and your child have provided our office with the required documents, we prepare and submit Step 1 of your application to the US government.

Once Step 1 of your application is approved you and your child will be provided with a tailored checklist of the documents we need to prepare “Step 2” of the Green Card application.

•  Prepare and Submit Step 2 of Application

Once we receive the required documents, our attorney will prepare and submit the application to the National Visa Center (US Embassy).

•  Green Card Interview at US Embassy/Consulate outside the USA

The last step of the process is the Green Card interview. The purpose of this interview is for a US government official to determine whether you meet the requirements for getting a Green Card and to confirm that you and your child are legally related as parent and child. This interview is done at a US Embassy/Consulate outside of the USA.

How long will a Green Card for the Child of a US Citizen last?

The Green Cards issued to the Child of a US Citizen will be issued for life.  The Green Card itself, just like a passport, expires every 10 years and is easily renewable. If your Green Card expires, it does not mean you have lost your Green Cards and need to re-apply. It just means you and your family need to take new pictures so that new cards can be printed.
